Shanghai Financial Court Held a Seminar on Foreign-related Financial Justice and Released Guide to the Trial of Financial Cases Involving Foreign, Hong Kong, Macao and Taiwan Affairs and 8 Typical Cases

On the afternoon of July 21, Shanghai Financial Court held a seminar on foreign-related financial justice. Xiao Kai, Member of the Party Committee and Vice President of Shanghai Financial Court, released the Shanghai Financial Court's Guide to the Trial of Financial Cases Involving Foreign, Hong Kong, Macao and Taiwan Affairs and 8 typical cases ofsuch financial disputes. The Guide consists of four parts divided into 19 chapters, with more than 330,000 Chinese characters. It comprehensively sorts out and answers the procedural and substantive issues in the trial of foreign-related financial cases, offering guidance for financial judges in the trial of financial cases involving foreign, Hong Kong, Macao and Taiwan affairs and providing explicit standards for the settlement of such financial disputes. The 8 typical cases cover a wide range, involving financial derivatives transactions, shareholding entrustment, independent guarantees, judicial review and preservation of foreign-related arbitrations, and application for enforcement of foreign-related judgments. They are helpful examples that will encourage international investment agencies’ financial activities in China, help regulate the overseas financing of Chinese enterprises, promote the protection of financial consumers and investors, and maintain the innovative and healthy development of the financial market. At the seminar, Shanghai Financial Court and East China University of Political Science and Law signed the Proof of Foreign Law Cooperation Agreement; the experts and scholars in foreign-related financial law research, the representatives of financial market infrastructure, arbitration agencies and law firms, and the financial judges of Shanghai courts discussed the hot topics of foreign-related financial justice.
