Recently, a delegation of international financial law experts attending the International Forum on Financial Justice in Shanghai visited the Shanghai Financial Court (SFC) for an “up-close and immersive” experience of China’s achievements in financial judicial practice, aiming to build a bridge for in-depth dialogue between Chinese and international financial law communities. The delegation included Sir William Blair, President of the Regulatory Tribunal of the Qatar International Court, former Judge of the High Court of England and Wales and former President of the London Commercial Court; Nicholas Calcina Howson, Professor at the University of Michigan Law School; Masayuki Tamaruya, Professor at the Graduate Schools for Law and Politics, University of Tokyo; and Robin Huang, Professor at the Faculty of Law, The Chinese University of Hong Kong. They were accompanied by Zhao Hong, President of the SFC..
PresidentZhao extended a warm welcome to the visiting delegates, noting that since its establishment seven years ago, the SFC has been committed to advancing international judicial exchanges and cooperation, having received visits from peers in the field of financial law from over 50 countries and regions. “Pudong is at the forefront of China’s reform and opening-up and a highland for the concentration of financial elements. This year, the SFC relocated to its new premises in Pudong, which will enable it to provide more timely and effective judicial services for financial innovation. We also hope that the experts here can experience the new atmosphere and new developments of China’s financial judiciary in this new building,” said President Zhao.
During the discussion, PresidentZhaointroduced the organizational structure and jurisdictional scope of the court, as well as its practical experience in building a “specialized, internationalized, and digital” world-class financial court.“We perceive that the financial legal systems of various countries are advancing through mutual learning and integration. And this is precisely the original purpose of the SFC in hosting international forums and enhancing judicial exchanges. We are willing to take this exchange as an opportunity to maintain contact and strengthen communication with financial legal experts from other countries, promote the improvement of the international financial legal rule system, and provide judicial support for building a more just, equitable, and orderly international financial legal environment,”said President Zhao.
Sir William Blair expressed his gratitude for the invitation to visit the SFC and shared insights into the practices of British courts in ascertaining foreign laws. “It has been seven years since my last visit in 2018. I have witnessed remarkable changes here. In particular, it has provided professional legal safeguards for China’s rapidly developing international financial market and has achieved fruitful results,” he said. He described the visit as informative and productive, fostering the exchange of perspectives and ideas. He also expressed hope that the SFC would disseminate more judicial practices and trial experience to the international financial law community, contributing insightsfrom Chinese judges to global financial governance.
The discussion was chaired by Gu Quan, Vice President of the SFC. Fu Wang, Standing Member of the SFC Adjudication Committee, presented the court’s practices in handling foreign-related cases. The participants engaged in in-depth discussions on topics such as the coordination between administrative and civil proceedings in the securities sector, mutual learning between statutory law and case law, and lawyer disciplinary systems.
President Zhao presented the guests with bilingual copies of A Collection of Typical Cases from Shanghai Financial Court (2018-2022).
Prior to the discussion, the delegation toured the Litigation Service Center and Cultural Exhibition Hall of the SFC. They also observed a court hearing in a foreign-related courtroom regarding an application to set aside an arbitral award, andexperienced firsthand the court’s digital judicial achievements, including the intelligent interpretation system for court hearings, the smart case-filing system, and the Securities Investor Protection Chamber.
Shan Suhua, Vice President of the SFC, along with heads of relevant departments and some judges, participated in the discussion.
During the International Forum on Financial Justice, President Zhao also met with Sir William Blair.
